Confirm the entity and information in scope
The Security Rule applies to electronic protected health information handled by covered entities and business associates. It requires administrative, physical and technical safeguards for confidentiality, integrity and availability. Health-related text alone does not establish HIPAA applicability: confirm the organisation's role and the information's context.

Trace clinical and administrative copies
Choose a workflow such as a referral or a billing query. Identify approved recipients, temporary exports, attachments and support access. Check whether the same record reaches a personal mailbox, unmanaged device or shared work area. Clinical terminology and identifiers may need to be considered together when evaluating discovery results.
Define an escalation route for legitimate care delivery. A restrictive policy that interrupts an authorised clinical transfer needs a safe exception process, an accountable owner and reviewable evidence.
Keep investigations from exposing more patient data
Use safe sample records to test discovery and transfer policies. Limit incident evidence to the context required for investigation, restrict reviewer access and document retention. Check both missed detections and unnecessary blocks. A screenshot or ticket containing a full patient record can become another exposure point.
Distinguish a security alert from a reportable breach
The Breach Notification Rule addresses breaches of unsecured protected health information. Notification duties vary by recipient and circumstances; HHS explains the applicable timing and assessment requirements. Assign a privacy decision maker rather than using a detector to determine notification. Track the Security Rule proposal separately from the currently applicable rules.
Practical checklist
- Confirm covered-entity or business-associate responsibilities.
- Map clinical and billing transfers, including temporary copies.
- Test safe exceptions for authorised patient-care workflows.
- Assign privacy review and notification decisions to an accountable owner.
Applying this with TRIAS
Evaluate TRIAS discovery and supported DLP channels using representative, non-production clinical examples. Confirm what the deployment detects and how authorised transfers and incident reviews work. These controls support the security programme; they do not replace HIPAA risk analysis or privacy decisions.
