Identify the rule and the record category
FINRA Rule 4511 addresses making and preserving required books and records, while Rule 3110 addresses supervisory systems and procedures. Specific record categories and other applicable securities rules determine the preservation requirements. Do not assign one retention period to all communications merely because the organisation is a FINRA member.
Keep approved communications within the supervised workflow
Map how customer instructions, attachments and internal reviews pass through approved systems. Identify where a personal account, new messaging tool or local export could bypass the firm's procedures. Define how the firm captures required records and who reviews exceptions.
Test whether an authorised message can be retained and retrieved after a handling control acts. Deleting or quarantining a copy without considering preservation may undermine a different control objective.
Keep customer safeguards separate from recordkeeping
SEC's Regulation S-P amendments address customer-information safeguards and incident response for covered institutions. The SEC guide identifies the compliance dates and covered entity types. Review this obligation alongside FINRA supervision rather than presenting the two as one universal privacy rule.

Review retrieval and exception evidence
Run a safe scenario from message creation through retention, review and retrieval. Record policy versions, responsible reviewers and the outcome. Check whether a DLP event, supervisory record and customer incident assessment can be correlated without copying unnecessary customer content into additional systems.
Practical checklist
- Map record categories to the relevant preservation rules.
- Identify approved channels and supervisory review owners.
- Test retrieval after a handling control intervenes.
- Assess Regulation S-P responsibilities separately from FINRA recordkeeping.
Applying this with TRIAS
Evaluate TRIAS classification and supported DLP channels against selected customer-data handling risks. Test interaction with the firm's retention and supervisory systems. DLP event records should not be presented as a replacement for compliant books-and-records infrastructure.
